Fulltext: ORDINANCE No. 70 FIXING THE RATES OF LICENCE FEES ON PUBLIC EATING PLACES, AND ON THE BUSINESS 1QF FOOD CONTRACTORS OR FOOD CATERERS. ·BY virtue of the authority conferred _upon_ me as Mayor of the City of Manila, and after consultation with the City Board, it is ordained that: SECTION 1. Licenses.-No pe·rson shall own, maintain, conduct, or operate any public eating place commonly known as restaurants, . cafes, cafeterias, panciterias, carinderias, merendero and cafeteria, or engage in the business of food contractor or food caterer for com;pensation by the food served or by the meail or by 'the day, week or month or part thereof, without first Jiaving obtained a permit from the Mayor upon payment of a fee of five pesos, and a license from the City Treasurer, which shall be issued upon presentation of such per~it. SEC. 2. Classes, fees.-For the purpose of this ordinance, public eating places are grouped and classified according to their location, and they and food con'tracb.Jrs and food caterers shall pay annual license fees a.~ f o:llows: Districts of Bagumbayan, Bagumbuhay, Bagumpanahon and BagU.ndiwa. SEc. 3. Definition of terms.-In this Ordinance the definition or meaning of various words used therein shall be as follows: (a) Public eating places refers to any place or establishment where food is served to the public for consideration. It includes (1) panciteria, (2) restaurant, cafe and cafeteria, (3) merendero or cafeteria, and ( 4) carinderia. (b) Panciteria signifies a public eating place where pancit, chopsuey, kimlo and any other Chinese dishes are prepared and served either by order or at a fixed price per cover or per meal. ( c) Combined restaurant, caf e and cafeteria shall include any public eating place where native and foreign foods or dishes are prepared and served as per order or at a fixed price per cover or per meal and which also serves coffee, chocolate or milk. (d) Merendero or Cafeteria is a public eating place where "meriendas", "snacks" or light foods consisting of coffee, chocolate, · milk, cakes, doughnuts, cookies, etc., are served between regular meals. (e)' Carinderia means a public eating place where native foods commonly known as "sinigang", "adobo", "mole", "kare", "paksiw", "fritada", "guinisang gulay" "fritong isda", ''kilawin", "bulanglang", "dinuguan", "linagang manok", or "karne", picadillo", "lichon", "tortilla", "pinakbet", "bachoy", including "lugilog may sabaw" and "luglog walang sabaw", and other native viands are prepared and served. (f) Food contractor is one who undertakes to furnish food, refreshment and/ or drinks in banquets, parties or gatherings and who has no regular establishmen~ of his own for serving or selling such food, refreshment or drinks. (g) Food catereT is one who furnishes meals to individuals, usually in dinner ·pails (fiambreras) and who has no regular establishment of his own for serving such .. meals but instead takes them to the places of his customers. Ang may ari o tagapangasiwa ng alin mang hayag na pook na pakainan ay dapat magingat ng isang talaan ng kanlyang napagbibilhan sa araw-araw, na kailangang bukas sa pagsusuri sa alin mang panahon ng tagaingatyaman ong siyudad o ng mga pinahihintulutang kinatawan nito at gaganapin niya ang tungkulin ng nasabing may-ari o tagapangasiwa na iharap sa tagaingatyaman ng siyudad ang isang maikling paha .. yag nang kabuuan ng napagbibilhan sa tatlong bu .. wan o mga katibayan sa katapusan ng bawa't tatlong buwan, ayon sa kalendaryo nang hindi lalagpas ang ika-dalawampu't limang araw mula sa katapusan ng nasabing tatlong buwan, at nguni'y dapat matalastas sa katapusan, Na kung magkaroon ng ano mang alinlangan tungkol sa halagang sisingiling buhat sa pagkakahidwaan ukol sa kinalalagyan, ang pinakamataas na buwis ang ipapataw. TUNT. IKA-3. Pakahulugan sa mga. Kataga.-Sa Kautusang ito ang pakahulugan o kahulugan ng iba,t ibang salitang ginamit dito ay ang sumusunod: (a) Ang hayag na pook na pakainan ay tumutukoy sa alin mang pook o tindahang nagdudulot ng pagkain sa madla, alang-alang sa bayad. Kasama nito (1) ang pansiterya, (2) restaurant, kape, at kapeterya, (3) mirindalan o kapeterya, at (4) karihan. (b) Ang Pansiterya ay naingangahulugang isang hayag na pook na pakainang nagluluto at nagdudulot ng pansit, "ch.opsuey", kimlo, at alin mang iba pang pagkaing intsik, na sadyang hiningi o sinisingilan nJill isang takdang halaga sa bawa't tao o sa bawa't hain. (c) Sa magkasamang restaurant, kape at kapeterya, ay kabilang ang alin mang hayag na pook na pakainan, na pinaglulutuan at idinudulot ang mga pagkain o ulam na pilipino at ng dayuhan, ayon sa hingin o sinisingilan ng isang takdang halaga sa bawa't tao o sa bawa't hain at nagdudulot din ng kape, tsokolate, o gatas. ( d) Ang minindalan o kapeterya ay isang hayag na pook na pakainang pinagdudulutan ng minindal, ·magaang o kaunting pagkaing binubuo ng kape, tsokolate, gatas, mamon, "doughnuts", kakanin, 3t iba pa, sa pagitan ng karaniwang pagkain. ( e) Ang karihan ay nangangahulugan ng hayag na pook na pakainang pinaglul~tuan at nagdudulot ng pagkaing pilipinong kilala sa tawag na sinigang adobo, mole, kare, paksiw, apritada, ginisang gulay, pritong isda, kilawin, bulanglang, dinuguan, linagang manok o karne, pikadilyo, litson, tortilya, pinakbet, bntsoy, kasama na ang luglog na may sabaw at luglog na wailang sabaw at iba pang ulam na pilipino. (f) Ang kumakasundo sa pagdudulot ng pagkain ay ang sino mang nagdudulot ng pagkain, pampalamig at/o inumin, sa mga piging, handaan o pagtitipon at walang pangkaraniwang tindahang sarili upang makapaglingkod o magbili ng nasabing pagkain, pampalamig o inumin. (g) Ang nagdadala ng pagkain ay ang sino mang nagdudulot ng pagkain sa bawa't tao, na karaniwang sa pamamagitan ng "fiambrera" at walang pangkaraniwang tindahang sarili upang makapaglingkod ng nasabing pagkain kundi inihahatid ito sa pook na kinaroroonan ng kakain. [ 26] _SEC. 4. Manner of payment.-The license fees prescribed herein may be paid annually, semi-annually, or quarterly at the option of the taxpayer. SEC. 5. Existing municipail ordinances pertaining to license fees on public eating places in the former Quezon Clty (now known as Dilhnan and Balintawak) and the former municipalities of San Juan, Mandaluyong, Makati, Pasay, Para:fi.aque and Caloocan, in force before the effectivity of Ordinance No. 62, are hereby revived and shall remain in force · until otherwise revoked. SEc. 6. Repealing clause.-Ordinance No. 62, approved on August 29, 1943, and Ordinance No. 2439 and all other ordinances or part thereof in the City of Manila, inconsistent herewith are hereby repealed. SEC. 7. Effectivity.-This ordinance shall take effect on the 1st day of October, 1943. Done at the City of Manila, Philippines, this 1st day of October, 1943. (Sgd.) LEON G. GUINTO Mayor TuNT. lKA-4. Paraan ng pagbabayad.-Ang buwis sa lisensiyang nakatakda rito ay maaaring bayaran ng taunan, anhnang buwan o tuwing ikatlong buwan, ayon sa marapatin ng nagbabayad ng buwis. TUNT. !KA-5. Ang mga umiiral na kautusang munisipal na nauukol sa buwis sa lisensiya sa mga hayag na pook na pakainan sa dating Siyudad Quezon (na ngayon ay kilala sa Dilhnan at Bailintawak) at ang mga dating munisipyo ng San Juan, Mandaluyong, Makati, Pasay, Pailanyag, at Kalookan, na sinusunod bago nagkabisa ang Kautusang Big 62, ay muling binubuhay sa pamamagitan nito at mananatiling may bisa hanggang sa pawalang halaga.
