That the sum of ten million pesos is hereb.y appropria"ted out of any funda in the Insular Treaaury not otherwise appropriated, for expenditu.re as hereinafter provided. SEc. 2. This aum shall be used for the promotion of education in our barrio communities, for the development of consolidated intermediate and barrio junior high schools, and for the construction of buildings. SBC. 3. The amount of Ave hundred thousand pesos will be made available each year for a period of twenty years. This amount will be spent under the direction of the Director of Edueation with the approval of the $:ecretary of Public Instruction. · . SEC. 4. This Act shall take effect upon ita approval. El PRESIDENTE. Tiene la palabra el Comité. INFORME ORAL DEL PONENTE, SR. OSfAS El Sr. OSfAS. In 1907, Mr. President, the very tirst bill enacted by the Philippine Assembly was a measure which Is educational in its nature. It provtded funds from year to year for education in the Da.rrio communities and for the cons~uction of LEGISLATURA FILIPINA . :201 buildings. Nearly twenty years have elapsed and various communities in the Philippine Islands received benefits resulting from the passage of that bill and by the enaetment of subsequent measures . along similar lines conceived in that historie bill knówn as Act 1801. One of the eternal problema of governments, Mr. President, is to equalize not only the burdens and responsibilities whicli indivíduals &J:id . communities ought to bear but also the benefits and blessings that should a.Ccrue from the Government. We hold that the barrio communities and the barrio inhabitants are equally entitled to the benefits to which are entitled thoile living in the most favored communities, and most populated cities. Another objective of the bill presented for the consideration. of the Senate this afternoon is to take a further forward step after twenty years of experimentation in the organization and administration of ~ducation in the barrio communities. One of the defects observed in the study of the educa-· tional situation in the Islands is found in the fact that a preponderant majority of boys and girls in our country who enter scliool do not go beyond the primary grades, and this is natural as long as the barrio schools established are for the most parts of two grades, three grades, or four grades. One of the purposes whicli we hope will be brought about will be the establishment of complete elemen. tary scliools in the Jarger barrios more centrally located and accessible to barrios surrounding it or located near it, which smaller barrio scliools would serve as feeders, as it were, for the classee in the higher grades. We also hope that by an improvement in this direction, we would enrich and vitalize instruction by turning out pupils who would acquire knowledge for farm life rather than pupils who tum their back to the farm. One prominent university president in America accused the American nation as a sixth grade nation, meaning thereby that the majority of its inhabitants seemingly do noi go further in their educational training than the sixth grade. If this is true in the United States whicli, relatively, is an older and a richer country than ours, it stands to reason that 'l"e have to take positive steps in order to raise the Cultural leve! intelligence among the masses of . the Philippine population. The consolidation problem is one of the two or three major problema of education whicli. America has. to grapple W!ith in tbe solution of its intri~ate and manifold educational problema. This problem of consolidation has necessitated a parallel development of the highways and in our country we are fast developing our highways not alone those connecting the mllnicipalities but those connecting the barrios with the municipalities. · The hope is entertained that with the establishment of scliools contemplated in this measure, a greater degree· of progresa in the development of highways would be brought about through increased ·motives, through increased incentives whicli would be .more clearly seen by our communi'ties in the barrios than they had heretofore seen. I am going to be very brief and have very little more to add which is this. This measure was pre~d soon after the close of the first session of the Seventh Philippine Legislature. We referred the matter to the educational authorities engaged ac~~ni~/~~rd~;:a'ti~n m.:':'íhfs"';,,\.~~'!. ª!~~':!:.i the unanimous approval of the division superintendents of schools in convention assembled at Baguio last May of this year. If we appro"Ve this measure, we Will once more demonstrate the proverbial !ove of the Legislature for education. Once this is enacted and the educational authorities carry on the work contemplated in this measure, what will be the outcome? We shall not only foster the cultural advancement of our rural communities,' we shall not only incre8se the number of buildings constructed, but we shall also decrease the illiteracy now in existence ín our country, because after ali the permanent solution of the problem of illiteracy has to go into the root of the matter beginning with the education of the chíidren. When this measure is enaeted and the work is begun, I entertaln the hope, Mr. President, tbat a new ray of hope will enter tbe hearts of our barrio inhabitants, a new glory will beam in their faces, a new vision will arise in their minds, and the Philippine Islands will reap abundant harvest, the best and most precious harvest, a human harvest consisting of rural boye and girls cultivated and nurtured in these schools that are to be built and established now ripened into better and happier citizens. El !;Ir. QUIRINO. Mr. President. El PRESIDENTE. The gentleman from the First -District. MOCIÓN QUIRINO El Sr. QUIRINO. Mr. President, I move that the discussion of this bill be continued next Monday. I wish to reason out my motion. We appropriate ten million pesos whicli is a very respectable sum. The bill does not state the system uilder which this fund is going to be distributed among the barrio scliools and junior high schools. I think, Mr. President, that it is important that we lay down a definite plan for tbe distributioil of this fund to avoid favoritism. I am confident that the Director of Education and the Secretary of Public Instruction will duly distribute this money in. accordance with our wishes but it is always a better sclieme to set a clearly, well defined policy with regard to the distribution of funds for . public school purposes. It is important that the legislators are aware of how these funde are going to be distributed. On !Íeveral oecasions, senators and repreSentatives have been at a loss to ascertain the basis in granting aids to elementary schools. It is for the sake of obviating this difficulty and doubt that I propose that the discussion of this bill be continued on Monday to give ils ample time to study and suggest the system under whicli tbis fund may be distributed. -El PRESIDENTE. The Senate precisely agreed to postpone the immediate consideration of this bill, which was contemplated for yesterday, until to-day. 1 do not believe that the reasons adduced by the gentleman from the First District (Sr. Quirino) are sufficiently weighty to argue for the postponement of the consideration of this measure till Monday. Bilis of a similar nature are found in our statute books and in no one of these bilis similar to the measure here presented for the consideration of the Senate to-day has the Legislature incorPorated the features which seemingly constitute powerfull reasons. for advocating long postponement. lt is known, Mr. President, that for twenty years and more the distribution of money for the support of schools and for 'construction PUrPoses had .been entrusted to educational authorities. Furthermore, there is another reason which, because tltis question carne. up this afternoon 1 am constrained to have to announce in ad van ce of the report of the J oint Committee of the Legislature on education. The · reasons adduced by the author of the bill aa well as the argumente advanced and the amendments Blinounced by the gentleman from the Fourt District (Sr. Tirona) have strengthened my stand in insisting now for . the postpone· ment of the discussion of thiii bill until Monday. I wish to correct the impression that the laws heretofore approved by the Legislature do not specify the basis for the distribution of funde of this kind. The thirty million pesos appropriated by Act No. 2782, the so-called Guzman Act, for the aid to elementary schoi>ls, put in the hands of the Council of the State the distribution of the tbirty million pesos. The Council of State is no longer in existence. This institution, I take it, would be a sulllcient guarantee to usas repre8entatives of the people that the -funds would be distributed in accordance with our wishes. This bill puts the power to 'distribute the funds to be v.oted for in the hands of the Director of Education and the Secretary of Public Instruction exclusively. Although 1 do not mean to rob these gentlemen of the confidence which they ought to enjoy at least in their relations with us, still, folloWlng the suggestions of the gentleman from the Fourth District (Sr. Tirona) 1 believe that it is better that we clearly and unmistakably lay the basis of distribution, so aa to.avoid any errors in the interpretation of this and similar laws. . I am not aware that the gentleman from the ~ ond District (Sr. Osias) had ever discussed thia matter with the members of the Committee on Public Instruction. As far as 1 am concomed 1 do n<lt remember if we ever discussed this matter in the Committee. El Sr. Os!As. Will the gentleman yi~ld, Mr. President. · El PRESIDENTE. Ali I wish to say is that personally I had never had any hand nor did I ever take part in any discussion of this bill before it was submitted to the Senate ; so that i do not believe the gentleman from the Second District" (Sr. Osias) would now want me to renounce my right to contribute what little I could on the ftoor of .the Senate, to the end that a definite basis of distribution of the funds may be arrived at. I wish to assure the gentleman from the Second District that I am perhaps more interested than he is in the passage of this bill. Ali I want is that before this bill is approved we set down clearly and unmistakably tl¡e rules under which this fund is to be distributed. What we want to avoid is the · difficulty in the dlstribution of the fund, and in order to obviate this difficulty, as well suggested by the gentleman from the Fourth District (Sr. Tirona), it is necessar)' that we amend this . bill. He has am:endments to olfer and J also have my own amendntents. Considering the importance of the measure, it will not be harmed by the postponement of its conslderation until Monday. I wish to repeat, Mr. Presldent, that whole-heartedly I am in favor of this measure, but in order that it may be more definitely interpreted by those who are called upon to carry its purposes, it may not be amiss that we lay down speclfic rules or the method under which these ten million pesos are to be distributed among the barrio schools and the junior high schóols. . The other method is the distribution of funde in this. manner: 40 per cent on the basls of population, 40 per cent on the basis of attendance, and 20 per cent for distribution discretionary on the part of the educational authorities in order to equalize educational opportunities. The purpose of the latter provision, Mr. President, is that no community which has been enjoying certain benefits, made by virtue of the chango in the distribution of the funds, may suffer. I am in a position, Mr. President, to announce to the Senate that the distribution is not only scientific but meets with the approval both · of the members of the Joint Committee and the educational authorities consulted, so with the permission of the Senators from the Fourth District (Sr. Tirona) and the Sixth · District (Sr. Alegre), 1 would like to propose that we now sanction this bill by the inclusion of this provision after the word 11 years" in section 3. Creo que Ja enmienda por mi propuesta y las observaciones del Senador por el Segundo Distrito (Sr. Oslas) no son incompatibles. Mi enmienda deja en completa libertad al Secretario de Instrucción-Pública y a Ja Legislatura Filipina al objeto de·que puedan fijar las reglas· para una justa y equitativa distribución de Jos fondos que se trata de votar en este proyecto de ley. La observación del Senador por el Segundo Distrito (Sr. Osias) asl como Ja del Senador por el Sexto Distrito (Sr. Alegre) tienden de antemano a establecer una base fija para esa distribución. Yo no sé si el Seliado está en condiciones de ver el alcance de esta distribución. Y o no sé si una regla en el sentido de tener en cuenta el grado de asistencia escolar, el número de habitantes de cada provincia y el área o extensión . de terreno de esa provincia, seria una base justa y equitativa, de tal manera que se evitase en lo futuro toda posible distribución parcial de esa cantidad. Puede que esa base sea inaplicable a algunas provincias. Si fuéramos a admitir una norma fija en estos precisos momentos en· que no hemos considerado aún las necesidades de cada provincia, nos verlamos atados con esta enmienda del Seliador por el Sexto Distrito (Sr. Alegre) o con la que ha anunciado el Senador por el Segundo Distrito (Sr. Osias). Ya no nos seria posible cambiar dicha norma. Pero con mi Jmlllienda dejamos en libertad. a Ja Legislatura para que estudie Ja mejor forma da distribución. 'Si Ja Legislatura o J_os miembros de este Cuerpo estuvieran convencidos de que Ja mejor norma de distribución es la propuest,a l'ºr el SeLEGISLA TURA FILIPINA 205 nador por el Sexto Distrito (Sr. Alegre), o la pro11uesta por el presidente del Comité de Instrucción Pública, podríamos optar por una u otra norma. En cambio, si nosotros aceptamos lo propuesto por uno y otro caballero, puede que más tarde nos encontremos con dificultades al tratar de aplicar esa norma. Por eso creo mejor que se acepte mi enmienda, sencillamente, porque conservamos, hasta cierto punto, el .. control" sobre la forma en que se han de distribuir los fondos. Nada más jailto que este ºcontrol" lo conserve la Legislatura, porque se ti-ata de ¡,ina grueaa cantidad, a saber, de medio millón de pesos anualmente, hasta cubrir la cantidad de diez millones. Naturalmente, las normas seguidas por la Oficina de Educación, aunque sean buenas, por lo mismo que son desconocidas-al menos para mi-yo no las puedo aceptar de momento, y la única manera de evitar ese posible peligro consiste en adoptar un críterío abierto a cualquiera otra proposición ulterior. El Sr. VERA. ¿Y no cree Su Seiioría que para la minoría dentro de las dos Cámaras seria más conveniente que se establecieran en este mismo bill las bases de esa distribución para que en cierto modo la mayor!a no pueda aprovecharse de todas las ventajas? . · El Sr. TIRONA. El fin que persigue Su Seiioría se cumplirla también si se aceptase mi enmienda, porque decimos que eaas reglas de distribución preparadas por el Secretario de Instrucción Pública tienen que ser aprobadas previamente por la Legislatura Filipina. Quiere decir que cuando se discutan esas reglas o las bases que necesariamente han de establecer esas reglas, tanto la mayoría como la minoría tendrían amplia oportunidad para discutir la bondad o la maldad de dichas bases, al paso que estableciéndose una base fija, ni Su Seiiorfa ni yo miamo estaríamos en condiciones de decir con plena seguridad que esas bases son las mejores y ya no pueden encontrarse otras. De modo que aun con la aprobación de mi enmienda, quedan ·garantizados los derechos tanto de la mayoría como de la minoría, como Su Seiioría dice . . El Sr. VERA. ¿Quiere decir Su· Seiioria que eaas bases han de discutirse y determinarse de una sóla vez y no de año en año? El Sr. TIRONA. Eso dependería del criterio de la Legislatura. Si nosotroa aceptáramos una norma fija desde ahora, paraee que esa norma habría de ser Jle!m&nente mientras .no se hayan gastado ·los diez millones de pesos. Suponiendo que el Secretario de Instrucción Pública no sometiera las reglas a que se refiere este proyecto en todo el presente periodo de sesiones de la Legislatura, ¿qué efecto producirian las disposiciones del presente proyecto en . el alío actual? El Sr. TIRONA. Aunque· es un caso hipotético el citado por Su Seiioria, debo decirle que la Legislatura tiene derecho a dictar otra ley fijando de antemano esas bases sin esperar· a que las proponga el Secre. tario de Instrucción Pública, y debemos suponer por nuestra· parte, que el Secretario de Instrucción' Pública tiene tanto interés como nosotros en propulsar la instrucción, y debe presumirse que todo funcionario cumple con su deber. El Sr. QUIRINO. ¿No cree Su Seiioria que, ya que· se trata de establecer una norma de distribución de esos fondos, la podrí11111os insertar ya en este pr~ yecto? El Sr. TIRONA. Si, pero ... El Sr. QUIRINO. ¿.Y la razón por que no podemos insertarla es porque todavia no nos es posible conocer las reglas que ha de proponer el Secretario de Instrucción Pública, y en cuyo caso, seria conveniente posponer la considerauón de este proyecto para eatudiar la forma de insertar de .una vez esa base ile distribución? El Sr. TIRONA. Ese procedimiento seria dilatorio, mientras que aprobándose ahora con las enmiendas que quisiéramos introducir, se ganarla tiempo, porque, si se aprueba el proyecto, pasarla luego a la otra Cámara, y aprobado por ésta, inmediatamente sería remitido al Poder Ej,cutivo, y un" vez aprobado por éste, el Secretario de Instrucción Púbrlca podrfa someter esas reglas que luego podrán ser aprobadas o no. · El Sr. QUIRINO.
