Bernardo, Municipal Building-'! el. 6-7 4-26 OFFICIAL ORGAN OF THE CITY GOVERNMENT .-, CITY ORDINANCES ORDINANCE No. 19 KAuTusANG BLG. 19 REGULATING THE SLAUGHTER OF ANIMALS IN THE CITY OF MANILA, AND FOR OTHER PURPOSES. By virtue of the authority conferred upon me as Mayor of the City of Manila, and after consultation with the City Board, it is ordained that: SECTION 1. Slaughter in publi~ slaughterhouse.No person shall slaughter any four-footed animal for food or sale, or cause ·or allow the same to be done, except in a public slaughterhouse; provided that suckling pigs not less than five weeks old and kids not less than eight weeks old of not more than fifteen kilos in weight, may be slaughtered in private premises, for personal use only and not for sale. SEC. 2. Observation of animals before they are slaughtered.-It shall be unlawful to kill for purposes of sale as human food any cattle, carabao, horse, swine, sheep or goat, chicken or any fowl, unless said animals have been kept in a City stockyard for observation and examination for a period of not less than twentyfour hours, in order to determine whether or not they are suffering from any communicable disease or are otherwise unfit for human consumption, or unless otherwise authorized by the government veterinarian in charge. • SEC. 3. Offecial making observation; fees and costs of keeping·.-Tlfe observation and examination required in the preceding section shall be conducted by the chief government veterinarian in charge of the slaughterhouse or his duly authorized representative whose decision shall be final. While the animals are under observation, they shall be placed under the care of the Division of Veterinary Service, Office of the City Health Officer, for which the following daily fees shall be collected in advance: For each cattle For each carabao ............................................... . Pagsusuri sa mga hayop bago katayin.-Magiging labag sa batas na patayfn upang maipagbilf at makain ng mga tao ang alin mang baka, kalabaw, kabayo, baboy, tupa o kambing, man6k o pato at iba pa, matangi na lamang kung ang nangasabing hayop ay ipinasok sa isang kulungan ng mga hayop ng Siyudad upang mapagsuri at masiyasat, sa loob ng isang taning na di kukulangin sa dalawampu't apat na oras, upang matiyak kung mayroon o walang taglay na ano mang sakft na nakahahawa, o kaya'y hindi nababagay kanin ng tao, o matangi na lamang kaya kung may kapahintulutan ang beterinaryong katiwala ng pamahalaan. TuNT. IKA-3. Tagapagsuri ng pamahalaan; singilin at halaga ng pag-aalaga.-Ang pagsusuri at pagsisiyasat na itinatadhana ng sinundang tl1ntunin ay gagawin ng pinunong beterinaryong katiwala ng pamahalaan sa pakatayang pangmadla o kaya'y ng sad-· yang ,inaatasang kinatawan, at ang ipasiya nila ay magiging pangwakas. Samantalang pinagsusuri ang mga hayop, ay masasailalim ng pangangalaga ng Pangkat sa Paglilingkod ng Beterinaryo, Tanggapan ng Pinuno ng Kalinisan ng Siyudad, at dahilan diyan ang sumusun6d na pang-araw-araw na sfngilin ay lilikumin nang pauna: Sa bawa't baka ........................................................ SEC. 4. Sale; application of proceeds.-If the owner of an animal under observation should, for a period of fifteen days after their fitness for human consumption has been determined, allow the same to remain in the stockyard or should fail within the same period to pay the corresponding fees and the costs of their keeping and maintenance in the stockyard, said animal may be sold at public auction to. the highest bidder; and the proceeds of the sale shall first be applied to cover the amount of such fees and costs, and the balance shall be turned over to the owner ·of the animal. If no claim for said balance is made within three months from the sale, the same shall accrue to the general funds of the City of Manila., SEC. 5. Animals rejected for slaughter.-Save as provided in the following section, whenever an animal is rejected for slaqghter, the government veterinarian in charge shall caus·e to be clearly stamped on the original certificate of ownership and on every certificate of transfer the words "Rejected for slaughter", giving the name of the slaughterhouse and the date of rejection, under his signature. If the owner of the animal requests it, a certificate may be issued by said veterinarian, stating the cause for the rejection of the animal. · No animal rejected for slaughter in any slaughterhouse shall thereafter be admitted to slaughter in the same or other slaughterhouse unless the cause for such rejection shall have been removed, in which case the veterinarian who first rejected the animal shall be consulted and shall cross out the stamp of rejection on the certificates, also under his signature, if, in his opinion, such cause is no longer present. SEC. 6. Disposition of condemned animals.-Whenever the veterinarian in charge of the slaughterhouse · condemns an animal in accordance with the provisions of this Ordinance, said animal shall be disposed of according to the provisions of section 1228 of the Revised Ordinances of the City of Manila. SEC. 7. Pagbibili; pag-uukulan ng malilikom.Kung ang may-arl ng isang hayop na pinagsusuri, sa loob ng taning na panah6ng labinlimang araw matapos maipasiya ang pagka-maaaring kanin ng tao, ay magpabayapg ang kaniy,ang hayop ay patuloy na manatili sa kuiungan, 6 kaya'y magkulang sa looh ng nasabing taning ng bayad na nauukol na singilin at ng halaga sa pagpapaalaga at pagpapakain sa loob ng kulungan, ang tinurang hayop ay ipagbibili nang hayagan sa may !along mataas na tawa~; at ang malikom sa pinagbilhan ay kukunang una ng buong ~alaga ng mga singilin at gugol, at ang malalabi ay isasauli sa may ... "ri ng hayop. Kung walang naghahabol . sa labis ng napagbilhan sa nasabing hayop sa loob ng tatlong huwan mula sa pagkapagbili, ang nasabing labis ay isasama sa pangkalahatang pananalapi ng Siyudad ng Maynila. TuNT. IKA-5. Mga hayop na tinanggihang katayin.Liban sa itinatadhana ng sumusun6d na tuntunin, kapag ang isang hayop ay ipinasiyang hindi makakatay, ang beterinaryong katiwala ay mag-aatas na tatakang maliwanag ang katutubong katibayan sa pagmamayari at ang lahat ng katibayan sa pagsasalin ng mga salitang "Di-Makakatay" (Rejected for slaughter"), at ilalagay ang ngalan ng pakatayan at ang araw ng pagkakapasiya ng ganit6 na may lagda niya. Kung hihingin ng may-ari ng hayop, ay makapagkakaloob ng isang katibayan sa pagpapatunay ng tinurang beterinaryo, na kinasasaaran ng sanhi ng pagkakapasiyang di-makakatay ang hayop. Alin mang hayop na ipinasiyang d_i maaaring katayin sa alin mang pakatayan o sa iba pa man, ay di na matatanggap maliban na lamang kung ang sanhi ng gayong pasiya ay napawi na, at sa ga!lit6ng pangyayari, ang beterinaryong unang nagkait ng pahintulot sa pagkatay sa llayop ay dapat na sangguniin muna at guguhitan ng pahalang ang tatak ng pagkakatanggi sa mga katibayan, sa ilalim din ng kaniyang lagda, kung sa kaniyang palagay, ang nasabing sanhi ay napawi na. TUNT. IKA-6. Pagpapasiya sa tinanggihang hayop.Kapag ang beterinaryong namamanihala sa. pakatayan ay tumangging katayin ang isang hayop, sang-ayon sa mga tadhana ng Kautusang it6, ang nasabing hayop ay pagpapasiyahan nang sang-ayon sa mga tadhana ng Tuntuning ika-1228 ng Sinuring mga Kautusan ng Siyudad ng Maynila. TuNT. IKA-7. Paglabcig at parusa.-Sino mang taong lumabag sa alin mang tadhana ng Kautusang it6 6 sa pamamagitan ng daya ay magpakatay ng alin mang hayop na tinanggihan na sa alin mang pakatayang pangmadla, at ipagbili rin upang makain ng tao, ay parurusahan ng isang multang di hihigit sa dalawang daang piso, o ng pagkabilanggong di hihigit sa anim [2] t such fine and imprisonment, in the discretion of the court. SEC. 8. Effect upon existing ordinances.-The whole or part of any existing City or Municipal ordinance now in force in the component parts of the City of Manila which is inconsistent herewith is hereby repealed. GUINTO Mayor .. • ORDINANCE No. 26 FIXING FEES FOR CERTAIN SERVICES RENDERED BY THE OFFICE OF THE CITY ENGINEER AND ARCHITECT OF THE CITY OF MANILA TO OTHER BRANCHES OF THE GOVERNMENT OR TO ANY PRIVATE PERSON. By virtue of the authority conferred upon me as Mayor of the City of Manila, and after consultation with the City Board, it is ordained that: SECTION 1. When the Office of the City Engineer and Architect renders the services hereinbelow 'enumerated to other branches of the Government o.r to a private person, association, company or corporation, fees shall be charged at the following rate: Per sq. m. (a) For repair of macadam streets with depth affected less than 0.80 meter........ P2.50 (b) For repair of macadam streets with depth affected from 0.80 to 1.20 meters 3.50 ( c) For repair of asphal~-macadatn streets with depth affected less than 0.80 meter ............................................................. . ' BERED I, "REQUIRING THE REGISTRATION AND LICENSING OF BICYCLES AND PRESCRIBING RULES AND REGULATIONS FOR BICYCLE TRAFFIC IN THE CITY OF MANILA." By virtue of the authority conferred upon me as Mayor of the City of Manila, and after consultation with the City Board, it is ordained that: SECTION 1. Section 1 of Ordinance No. 1 "Requiring the Registration and Licensing of Bicycles and Prescribing Rules and Regulations for Bicycle Traffic in the City of Manila," is hereby amended to read as follows: "SECTION 1. Necessity of Registration and License.-Every person who shall own or possess a bicycle, whether for private use or for hire, shall register the same on or before February twentyeight of each year :with the Office of the Metropolitan Constabulkry Commander, who shall cause a registration certificate and the corresponding plate number to be issued to the regfstrant, upon payment of an annual fee (of two pesos and fifty centavos) ACCORDING TO THE SCHEDULE HEREIN BELOW PRESCRIBED: Provided, That bicycle acquired or purchased after February twenty-eight shall be registered within ten days after purchase or acquisition thereof; and Provided, further, That for every registration made after the dates herein prescribed, a surcharg~ of twenty per centum shall also be collected. ( c) Students whose parents are residing in the provinces may be admitted to the City high schools as Manila students provided such parents own property or have a business establishment in the City of Manila, for which taxes of not less than fifty pesos a year are paid to the City. ( d) Students whose parents move their residence to the provinces shall be excluded from the high schools of the City of Manila with the exception of (1) pupils or students whose parents possess properties or have established certain business or businesses in the City of Manila and pay taxes of not less than fifty pesos a year to the City; (2) pupils or students whose fathers, due to the nature of their employment, are detailed for duty in the provinces, but whose mothers remain in Manila. SEC. 3. Refund of tuition fee.-No student who is suspended or expelled for cause or who for any other reason stops going to school during the course of the school year shall be refunded the amount of tuition paid as prescribed in this Ordinance: Provided, That a student who stops studying within one month after admission, by reason of illness, transfer or other justifiable cause, may be refunded the initial installment paid. There is hereby established a public market, which shall be known as the "Intramuros Market", on the premises of the former R.O.T.C. Armory, located near the entrance of the Parian Gate in the d.istrict of Bagumbayan, whose limits and extension shall be as kept in the files of the City Engineer and Archit~ct. SEC. 2. The spaces in said market shall be conveniently divided into stalls, in accordance with the standard plan provided in section 8 of Ordinance No. 2898 of the former City of Manila, and a daily fee ng mga magulang o ng pinanumpaang pahayag sa nasabing pagkamatay. Definition and scope.-For the purposes of this Ordinance shooting galleries are establishments of recreation dedicated purely to sport for the promotion and development of skill in shooting. Wherein marksmanship is determined by the use of air-rifles, darts, spring pistols or other instruments not prohibited by law or ordinance in shooting at an immovable target board of not less than four or more than six feet in diameter. The said establishments may authorize the giving of prizes to "hits" as are ordinarily understood and said prizes shall be given only in consideration of skill or marksmanship and not as a result of chance. SEC. 2. License.-No person or entity shall keep, conduct or maintain any shooting gallery or establishment as defined in Section 1 hereof, nor shall allow, for any reward, compensation or other consideration, any person to shoot therein with air-rifles or any other instrument not prohibited by law or ordinance for throwing projectiles, without first having obtained a permit from the Mayor upon payment of a fee of five pesos and the corresponding license from the City Treasurer upon presentation to the latter of the permit duly approved. SEC. 3. Fees.-There shall be paid hereafter for every license granted for a shooting gallery, an annual license fee in accordance with the schedule prescribed TuNT. IKA-4. SA bisa ng kapangyarihang kalo6b sa aking pagkaAlkalde ng Siyudad ng Maynila, at matapos makasangguni sa Lupon ng Siyudad, ay ipinag-uutos na: TUNTUNING 1. Pakahulugcin at nasasaklaw.-Sa layunin ng Kautusang it6, ang "shooting galleries" ay mga po6k na libangang nauukol lamang sa lar6ng nagpapasigla at nagpapaunlad ng kasanayan sa pagtudla. Dito ang kasanayan sa panunudlA ay kikilalanin sa paggamit ng ripleng may hangin, palaso, · pistolang may panikad sa punlO o ibang kagamitang hindi ipinagbabawal ng batas o kautusan sa pagtudla sa isang di kumikilos na tudlaang may laking di kukulangin sa apat at di hihigit sa anim na talampakan. Ang nasabing pook na libangan ay makapagpapabigay ng mga gantimpala sa mga "nakapagpapatama" gaya ng karaniwang pag~akilala riyan, at ang tinurang mga gantimpala ay ipagkakalo6b lamang alang-alang sa kahusayan o kasanayan sa panunudla at hindi sanhi sa pananalong sapalaran. TUNT. IKA-2. Lisensiya.-Walang sino mang tao o samahang makapagmamay-ari, magtataguyod o mangangasiwa ng alin mang "shooting gallery" o po6k na patudlaan, ayon sa pakahulugan sa Tuntuning 1 nit6, at hindi rin matutulutan ang sino mang taong tumudla diyan sa pamamagitan ng ripleng may hangin o alin mang ibang kagamitang hindi ipinagbabawal ng batas o kautusang magamit sa panunudla ng punlo, kung alang~alang sa an6 mang pabuya, gantimpala o ano mang bagay, nang hindi muna nakakukuha sa Alkalde ng isang pahintulot, pagkapagbayad ng isang buwis na limang piso, at ng nauukol na lisensiya sa Taga-ingatyaman ng Siyudad sa paghaharap dito sa huli ng pahintulot na sadyang pinagtibay. TuNT. IKA-3. Pabuwis.-Magbabayad sa bawa't lisensiyang ipagkalo6b sa isang "shooting gallery" ng isang taunang pabuwis ayon sa batayang natatakda [ 13] hereunder, which may be paid annually or semestrally: Class A-With one target board located within a radius of one kilometer from Plaza Santa Cruz or within a radius of 500 meters from any public market, in the districts of Bagumpanahon, Bagumbuhay, Bagungdiwa and Bagumbayan ................... . Class B-With one target board and located outside of the radius prescribed in Class A, in the above-mentioned districts ................................................. . Prohibition.-lt shall be unlawful for the own_er, keeper, or maintainer of any shooting gallery to( a) Allow betting in cash or other consideration of value, by, with, or among the owner, keeper or maintainer, the players and spectators. (b) Allow the use of any defective instrument for target purposes: ( c) Use a movable target board. (d) Admit boys and girls less than 18 years of age for the purpose of participating· in any manner in any shooting gallery. SEC. 5. Revocation by the Mayor, conditions.-The Mayor may, at any time, in his discretion, revoke any license granted under this Ordinance; and if such license is revoked for a violation of this Ordinance or other law, part of the fee for said license for the unexpired term thereof shall be forfeited in favor of the City. SEC. 6. Penalty.-· Any person violating any of the provisions of this Ordinance shall be punished by a fine equivalent to tne amount of the license paid but not more than two hundred pesos, or by imprisonment for not less than one month nor more than six months, or by both such fine and imprisonment, in the discretion of the court, for each offense. In case of a second conviction, in addition to the punishment imposed by the court, the license of such person shall be cancelled and he shqll thereafter be disqualified from holding a license under the provisions of this Ordinance. SEc. 7. Pagbabawal.-Magiging paglabag ng may-ari o ng tagapangasiwa o nagtataguyod ng alin mang "shooting gallery", ang: (a) Magpahintulot sa mga naglalaro at nagsisipano6d ng pustahang salapi o. ibang -bagay na may halaga ang sino man sa may-ari o tagapangasiwa o nagtataguyod. (b) Magpahintulot ng paggamit ng alin mang sirang kagamitan sa panunudla. ( c) Paggamit ng gumagalaw na tudlaan. (d) Tumanggap ng mga batang lalaki at babaing walang 18 taong gulang sa layong makilahok sa ano mang paraan sa alin mang "shooting gallery". TUNT. IKA-5. Pagbawi ng Alkalde, pcitakaran.-Sa alin mang panah6n at sa sariling pagpapasiya ay ma<iaring bawiin ng Alkalde ang alin mang lisensiyang maipagkalo6b sa bisa ng Kautusang it6; at kung bawiin ang nasabing lisensiya sa paglabag sa Kautusang it6 o sa ibang batas, ang bahagi ng buwis na binayaran sa tinurang lisensiya sa panahong hindi natatapusan, ay iilitin upang maging ari ng Siyudad. TUNT. IKA-6. Parusa.-Sino mang taong lumabag sa alin mang tadhana ng Kautusang it6 ay parurusahan ng isang multang katimbang ng halaga ng lisensiyang binayaran, nguni't di hihigit sa dalawang daang piso, o ng pagkabilanggong di kukulangin sa isang buwan at di hihigit sa anim na buwan, o ng magkalakip na multa at pagkabilanggo, ayon sa marapatin ng Hukuman, sa bawa't isang pagkakasala. Sa ikalawang pagkakasala, bukod sa parusang ipinapataw ng Hukuman, ang pahintulot sa nasabing tao ay pawawalang-saysay at hindi na muling makapaghahawak ng lisensiya sa lilim ng mga tadhana ng Kautusang it6. TuNT. IKA-7. Mga tadhanang sumcisalungcit.-Ang mga tadhana ng Tuntuning 765, 766, at 767 ng Sinuring mga Kautusan ng dating Siyudad ng Maynila, at ang lahat ng nasasalungat ditong kautusan ng siyudad at munisipyong umiiral sa ibang bahaging na~msakop [ 14] of the City, which are inconsistent herewith, are hereby repealed. GUINTO Mayor ORDINANCE No. 46 FIXING LICENSE FEES ON THE ADJUSTMENT ' ALTERATION OR REPAIR OF NEON LIGHTS, AND FOR OTHER PURPOSES. BY virtue of the authority conferred upon me as Mayor of the City of Manila, and after consultation with the City Board, it is ordained that: SECTION 1. Permit.-No person or entity shall engage in the adjustment, alteration or repair of neon lights for gain or compensation, without first having obtained a permit from the Mayor. No permit shall be issued to any person other than a licensed electrical contractor or to any entity unless it has such licensed electrical contractor in its employ. SEC. 2. License.-In addition to the permit prescribed in the preceding section, a license shall also be secured from the City Treasurer, which shall be issued upon presentation of said permit, and payment of an annual license fee according to the schedule prescribed hereunder, payable annually, semi-annually or quarterly, at the option of the payer: Glass A-For the adjustment, alteration and repair of neon lights ------------------------ !>250.00 Clasl?
